These Terms and Conditions ("Terms") govern your access to and use of Vitare, an online social virtual world ("the Service"), operated by Daniel Willis trading as Vitare ("we", "us", "our"). Our registered contact address is Bartle House, 9 Oxford Court, Manchester, England, M2 3WQ.
By creating an account or accessing the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
These Terms constitute the entire agreement between you and Vitare and supersede any prior communications, representations, or agreements.
Definitions
"Vitare" — the online social virtual world available at vitaregame.com and via the downloadable client for PC and Mac
"Service" — Vitare and all related features, systems, and content provided by us
"Account" — your registered user account used to access the Service
"Player" — any registered user of the Service
"V$" or "Vitare Dollars" — the virtual currency used within the Service
"Lot" — a player-owned virtual plot of land within Vitare
"Virtual Items" — any in-game objects, currency, decorations, or assets associated with your Account
"Subscription" — a paid recurring membership providing enhanced benefits within the Service
"Beta" — the current phase of the Service, during which features may be incomplete, subject to change, or temporarily unavailable
"Content" — any text, images, character names, lot names, descriptions, or other material created or submitted by Players within the Service
Section 1 — Account Registration & Age Requirements
1.1 Eligibility
Vitare is strictly an 18+ service. By registering an Account you confirm that you are at least 18 years of age. We collect your date of birth at registration solely for the purpose of age verification. Accounts where we have reasonable grounds to believe the registered user is under 18 years of age will be suspended immediately and permanently without notice. If you believe an Account belongs to a person under 18 please contact us at support@vitaregame.com.
1.2 Registration
To access the Service you must create an Account by providing:
- A valid email address
- A character name of your choosing
- Your date of birth
- A password for your account
You agree that all information provided at registration is accurate and truthful. You must keep your Account information up to date. We reserve the right to suspend or terminate Accounts where we have reason to believe registration information is false or misleading.
1.3 One Account Per Person
Each player may maintain one Account only. Creating multiple Accounts to circumvent a suspension or ban, manipulate game systems, or gain unfair advantage is strictly prohibited and will result in permanent termination of all associated Accounts.
1.4 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials. You must not share your password or grant access to your Account to any other person. Any activity carried out under your Account is your responsibility, whether or not authorised by you. If you believe your Account has been compromised please contact us immediately at support@vitaregame.com.
1.5 Character Name
Your chosen character name is your public-facing identity within Vitare. Character names must not:
- Impersonate another player, public figure, or member of the Vitare team
- Contain offensive, hateful, or sexually explicit language
- Reference illegal activities
We reserve the right to require a character name change or reassign a character name at our discretion without notice.
1.6 Account Deletion by Player
You may request deletion of your Account at any time via the My Account area of vitaregame.com. On account deletion:
- Your Account and associated data will be permanently deleted within 30 days of your request
- Any V$ balance remaining in your Account will be forfeited and is non-refundable
- Any Virtual Items associated with your Account will be permanently removed
- Any active Subscription will be cancelled with no pro-rata refund for unused days unless required by applicable law
Section 2 — Acceptable Use
2.1 Nature of the Service
Vitare is an online multiplayer game involving real-time interactions with other real people in a world built entirely by its players. Whilst we are committed to maintaining a safe and enjoyable environment, the player-built and player-driven nature of the Service means we cannot monitor, review, or be held responsible for every interaction, conversation, or piece of content within Vitare. We will do our best to respond to reports and enforce these Terms but we cannot guarantee the conduct of other players.
By accessing the Service you acknowledge and accept this inherent nature of online multiplayer games and agree that Vitare cannot be held liable for the actions, behaviour, or content of other players.
2.2 Player Conduct
You agree to use the Service in a manner that is lawful, respectful, and considerate of other players. You must not:
- Harass, bully, threaten, intimidate, or abuse any other player
- Use offensive, hateful, discriminatory, or sexually explicit language in any public or private communication within the Service
- Impersonate any other player, public figure, Vitare staff member, or moderator
- Deliberately disrupt the experience of other players or the operation of the Service
- Engage in or facilitate any form of scamming, fraud, or deceptive practice toward other players
- Share, solicit, or distribute personal information about other players without their explicit consent
- Record, capture, or distribute conversations or interactions involving other players without their knowledge and consent
- Engage in any behaviour that would constitute a criminal offence under applicable law
2.3 Game Integrity
You must not:
- Exploit bugs, glitches, or unintended game mechanics for personal gain. Any discovered exploits must be reported to support@vitaregame.com
- Use third party software, bots, scripts, or automation tools to interact with the Service
- Manipulate the in-game economy, ranking systems, or fame mechanics in a manner not intended by the game design
- Attempt to interfere with, disrupt, or gain unauthorised access to the Service or its underlying infrastructure
- Reverse engineer, decompile, or modify any part of the Service or its client software
2.4 Player Created Lots & Content
Vitare allows players to build and operate their own lots within the game world. You are solely responsible for all Content you create, publish, or make available within the Service. You must not create, operate, or permit within your lot:
- Sexually explicit or pornographic content or spaces
- Content that glorifies, promotes, or simulates illegal activities
- Spaces designed to harass, humiliate, or target specific players
- Content designed to circumvent or undermine the age verification system
- Any exchange of real-world currency between players — all transactions must take place using V$ through Vitare's official systems only
- Content that infringes the intellectual property rights of any third party
2.5 Real World Interactions
Vitare facilitates connections between players online. Any decision to communicate with, meet, or interact with other players outside of the Service is entirely at your own risk. Vitare accepts no responsibility or liability for any interactions, arrangements, or consequences arising from contact between players that takes place outside of the Service. We strongly encourage players to exercise caution when sharing personal information or arranging to meet people they have encountered online.
2.6 User Generated Content
By creating or submitting any Content within the Service you:
- Confirm that you have the right to create and submit that Content
- Grant Vitare a non-exclusive, royalty-free licence to host, display, and distribute that Content within the Service for the purpose of operating the game
- Acknowledge that you remain responsible for that Content and any consequences arising from it
- Understand that Vitare may remove any Content at any time without notice if it is reported, deemed inappropriate, or found to violate these Terms
Where players upload or submit original creative works to the Service, including custom assets, images, or audio, the same licence grant applies. You confirm that you have the right to submit any such content and that it does not infringe the intellectual property rights of any third party. Vitare accepts no responsibility for player-uploaded content that infringes third party rights.
2.7 Reporting
If you encounter Content or behaviour that you believe violates these Terms you are encouraged to report it using the in-game reporting tools or by contacting support@vitaregame.com. We will review all reports and take action where appropriate, however we cannot guarantee a specific response time or outcome in every case.
Section 3 — Virtual Currency (V$)
3.1 Nature of V$
Vitare Dollars ("V$") is a virtual currency used exclusively within the Service. V$ has no real-world monetary value and cannot be exchanged, transferred, or redeemed for real money, goods, or services outside of the Service under any circumstances. Any attempt to sell, trade, or exchange V$ for real-world currency outside of Vitare's official systems is strictly prohibited and may result in account termination.
3.2 Earning V$
V$ can be earned within the Service through legitimate gameplay activities including but not limited to operating money-making objects, running a shop, hosting visitors, and participating in rankings and events. Vitare reserves the right to adjust V$ earning rates, payout amounts, and earning mechanics at any time as part of ongoing game balancing without notice.
3.3 Purchasing V$
V$ may be purchased directly using real-world currency via our payment processor, Stripe. All purchases are subject to Stripe's terms and conditions in addition to these Terms. Payment is processed securely by Stripe — Vitare does not store or have access to your payment card details.
Purchased V$ will be credited to your Account promptly following successful payment confirmation. V$ purchases are not currently available but this facility may be introduced in future. Where V$ purchases are made available this section will apply in full.
3.4 Non-Refundable
All V$ purchases are final and non-refundable except where required by applicable law. Under the UK Consumer Contracts Regulations 2013 you may have a right to cancel a purchase within 14 days. However by completing a V$ purchase you explicitly request immediate fulfilment of the purchase and acknowledge that your right to cancel may be lost once V$ has been credited to your Account.
3.5 Player to Player Trading
V$ may be transferred between players using Vitare's secure in-game trading system. All such transfers are final once confirmed. Vitare does not mediate, intervene in, or accept responsibility for disputes arising from player to player V$ transfers. Players are strongly encouraged to use the secure trading system and exercise caution when conducting trades.
3.6 Game Balancing
Vitare reserves the right to adjust, modify, or rebalance V$ values, the cost of Virtual Items, earning rates, and the broader in-game economy at any time. Such changes may affect the relative value of your V$ balance. These adjustments are a necessary part of operating a live online game and do not entitle players to compensation or refund.
3.7 Account Termination & Deletion
On voluntary account deletion, any V$ balance remaining in your Account will be forfeited and is non-refundable. On account termination by Vitare for violation of these Terms, any V$ balance will be forfeited without compensation.
Section 4 — Virtual Items
4.1 Acquiring Virtual Items
Virtual Items may be acquired through:
- Purchase from the in-game catalogue using V$
- Participation in gameplay activities, rankings, and events
- Player to player trading via Vitare's secure in-game trading system
- Subscription benefits where applicable
4.2 Licence to Use
By acquiring Virtual Items within the Service, whether through purchase, gameplay, trading, or any other means, you are granted a limited, non-exclusive, revocable licence to use those items within the Service for as long as your Account remains active and these Terms are complied with. This licence may be revoked at any time in accordance with these Terms.
4.3 Player to Player Trading
Virtual Items including lot deeds may be transferred between players using Vitare's secure in-game trading system. All such transfers are final once confirmed. Vitare does not mediate, intervene in, or accept responsibility for disputes arising from player to player item transfers. Players are strongly encouraged to exercise caution when conducting trades and to use the secure trading system at all times. Any trading of Virtual Items outside of Vitare's official systems is conducted entirely at the players' own risk.
4.4 Lot Deeds
Lot deeds are a special category of Virtual Item representing occupation of a plot of land within Vitare. Lot deeds have no real-world monetary value and represent a licence to occupy and develop that plot within the Service. Lot deeds may be traded between players via the secure in-game trading system.
4.5 No Real World Value
Virtual Items exist solely within Vitare and have no real-world monetary value. Virtual Items cannot be exchanged, transferred, or redeemed for real money, goods, or services outside of the Service under any circumstances. Vitare does not recognise any real-world market for Virtual Items. Any value attributed to Virtual Items by players or third parties outside of the Service is not recognised or endorsed by Vitare.
4.6 Modification & Removal
Vitare reserves the right to modify, adjust, remove, or discontinue any Virtual Item at any time, including items previously acquired by players. Such changes may be necessary as part of ongoing game development, balancing, or legal compliance. Where possible we will provide reasonable notice of significant changes to Virtual Items but are not obligated to do so. Players are not entitled to compensation or refund as a result of changes to Virtual Items.
4.7 Account Termination & Deletion
On voluntary account deletion, all Virtual Items associated with your Account will be permanently removed and are non-recoverable. On account termination by Vitare for violation of these Terms, all Virtual Items will be forfeited without compensation.
Section 5 — Subscription
5.1 Overview
Vitare offers an optional paid subscription providing enhanced benefits within the Service. Subscription is entirely optional — the core Service remains accessible to all registered players free of charge. Full details of current subscription benefits are available at vitaregame.com and may be updated from time to time.
5.2 Pricing & Billing
The current subscription price is £7.99 per month, billed monthly in advance on the date you first subscribe ("Billing Date"). Subscription renews automatically on each Billing Date unless cancelled in accordance with Section 5.4.
All payments are processed securely by Stripe. Vitare does not store or have access to your payment card details. You are responsible for ensuring your payment details remain valid and up to date.
Vitare reserves the right to change the subscription price with no less than 30 days notice. Where a price change applies to your subscription you will be notified directly. Continued subscription following the notice period constitutes acceptance of the new price.
5.3 Free Trial
Where a free trial period is offered, no charge will be made until the trial period ends. Unless cancelled before the trial ends your subscription will automatically convert to a paid subscription at the standard monthly rate. This will be made clear at the point of sign up.
5.4 Cancellation
You may cancel your subscription at any time via the My Account area of vitaregame.com. Cancellation takes effect at the end of your current billing period — you will retain access to subscription benefits until that date. No partial refunds are issued for unused days within a billing period except where required by applicable law.
On cancellation the following applies with immediate effect from the end of your billing period:
- You will retain access to one lot of your choosing — all other lots will become private and inaccessible to other players until your subscription is reinstated
- Any cosmetic items received as part of your subscription are yours to keep
- Any subscription-specific badges or indicators will be removed from your profile
- Any weekly V$ bundles or other recurring subscription benefits will cease
5.5 Cooling Off Period
Under the UK Consumer Contracts Regulations 2013 you have the right to cancel your subscription within 14 days of purchase without giving a reason. However by subscribing you explicitly request that benefits begin immediately and acknowledge that your right to cancel may be lost once subscription benefits have been activated and used. Where the account has not been used within the 14 day period a full refund will be provided upon request to support@vitaregame.com.
5.6 Refunds
Subscription fees are non-refundable except where required by applicable law or as described in Section 5.5. If you believe you have been charged in error please contact support@vitaregame.com.
5.7 Account Termination
If your Account is terminated by Vitare for violation of these Terms your subscription will be cancelled immediately with no refund of any fees paid. All subscription benefits will cease immediately upon termination.
5.8 Service Closure
In the event of permanent closure of the Service, active subscribers will be entitled to a pro-rata refund of subscription fees. Please refer to Section 10 — Service Closure for full details.
Section 6 — Moderation & Account Suspension
6.1 Our Approach to Moderation
Vitare is a player-built online world involving real-time interactions between real people. We are committed to maintaining a safe and enjoyable environment for all players. We reserve the right to moderate, review, remove, or restrict any Content, Account, or activity within the Service at our sole discretion.
Whilst we will endeavour to respond to reports and enforce these Terms fairly and consistently, the nature of a live online game means we cannot monitor every interaction or guarantee the behaviour of other players. Moderation decisions are made in good faith but Vitare accepts no liability for harm arising from the actions or conduct of other players.
6.2 Moderation Actions
Depending on the nature and severity of a violation of these Terms, we may take any of the following actions:
- Issue a formal warning to your Account
- Temporarily suspend your Account for a defined period
- Permanently terminate your Account without notice
- Remove or restrict Content created by you within the Service
- Remove or restrict access to specific features or areas of the Service
- Report conduct to relevant authorities where required by law
We reserve the right to determine the appropriate action at our sole discretion. Not all violations will result in the same outcome and repeat violations will be treated more seriously.
6.3 Grounds for Suspension or Termination
Your Account may be suspended or permanently terminated if we determine, at our sole discretion, that you have:
- Violated any provision of these Terms
- Engaged in conduct harmful to other players, the Service, or Vitare
- Provided false information at registration including misrepresentation of your age
- Created multiple Accounts in violation of Section 1.3
- Engaged in harassment, abuse, or threatening behaviour toward other players or Vitare staff
- Attempted to exploit, manipulate, or disrupt the Service or its economy
- Been found to be under 18 years of age
Engaged in any conduct that Vitare reasonably considers damaging to the reputation or operation of the Service
This list is not exhaustive. Vitare reserves the right to suspend or terminate any Account for any reason we consider sufficient to protect the Service, its players, or its operation.
6.4 Consequences of Termination
On permanent termination of your Account:
- Access to the Service will be immediately revoked
- All V$ associated with your Account will be forfeited without compensation
- All Virtual Items associated with your Account will be forfeited without compensation
- Any active subscription will be cancelled immediately with no refund
- Any lots associated with your Account will be reclaimed by Vitare
You are prohibited from creating a new Account without prior written permission from Vitare
6.5 Appeals
If you believe your Account has been suspended or terminated in error you may submit an appeal by contacting support@vitaregame.com within 14 days of the suspension or termination. Please include your Account email address and a clear explanation of why you believe the decision was made in error.
We will review all appeals and respond within a reasonable timeframe. Our decision following an appeal is final. Submitting an appeal does not guarantee reinstatement of your Account.
6.6 No Liability for Moderation Decisions
Moderation decisions are made in good faith based on available information. Vitare accepts no liability for any loss, inconvenience, or damage arising from a moderation decision, including loss of access to V$, Virtual Items, or the Service itself, where that decision was made in good faith in accordance with these Terms.
Section 7 — Beta Terms
7.1 Nature of Beta
Vitare is currently in a Beta phase of development. The game is actively being developed and will continue to evolve over time based on player feedback, technical requirements, and ongoing design decisions. By accessing the Service during Beta you acknowledge and accept that:
- The Service is not yet complete and may contain bugs, errors, or unfinished features
- Features, systems, game mechanics, and content may change significantly or be removed entirely without notice
- The Service may experience instability, downtime, or unexpected interruptions
- Your experience during Beta may not be representative of the final released version of the Service
7.2 Feedback
By participating in Beta you may be invited to provide feedback, suggestions, or bug reports. Any feedback you provide may be used by Vitare to improve the Service without obligation to you. Feedback does not entitle you to any compensation, credit, or reward.
7.3 Data During Beta
Vitare reserves the right to reset, wipe, or modify player data, Account information, V$ balances, Virtual Items, lots, and any other game data during the Beta phase where technically necessary or required for development purposes. We will endeavour to provide notice where possible before any such reset occurs. Where a data wipe affects active subscribers Vitare will endeavour to provide reasonable compensation at its discretion.
7.4 Transition from Beta
When the Service transitions out of Beta, Vitare intends to preserve existing Accounts, V$ balances, Virtual Items, and lot ownership wherever possible. We do not intend to delete player Accounts or erase progress at the point of full release. However the nature of live game development means that circumstances may require changes to this position. Any significant changes affecting player data ahead of or during the transition from Beta will be communicated with reasonable notice via vitaregame.com.
Section 8 — Intellectual Property
8.1 Vitare's Intellectual Property
All intellectual property rights in the Service, including but not limited to the Vitare name, logo, branding, software, client application, website, game systems, design, artwork, audio, and all Content created by Vitare, are owned by or licensed to Daniel Willis trading as Vitare. All rights are reserved.
You are not permitted to:
- Copy, reproduce, distribute, or publicly display any part of the Service without prior written permission from Vitare
- Use the Vitare name, logo, or branding in any manner that implies endorsement or affiliation without prior written permission
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or its client application
- Create derivative works based on the Service or any part of it without prior written permission
8.2 Third Party Assets
The Service may incorporate third party assets, software, or technology that are subject to their own licence terms. Vitare complies with all applicable third party licence requirements. Players may not reproduce, extract, or use any third party assets contained within the Service outside of the Service itself.
8.3 Player Content
Content created by players within the Service — including lot designs, character names, lot names, and descriptions — is created using Vitare's tools and assets within the Vitare environment. By creating Content within the Service you grant Vitare a non-exclusive, royalty-free, worldwide licence to host, display, and use that Content solely for the purpose of operating and promoting the Service. This licence ends when your Account is deleted or your Content is removed from the Service.
Where players upload or submit original creative works to the Service, including custom assets, images, or audio, the same licence grant applies. You confirm that you have the right to submit any such content and that it does not infringe the intellectual property rights of any third party. Vitare accepts no responsibility for player-uploaded content that infringes third party rights.
8.4 Feedback & Suggestions
Any feedback, suggestions, or ideas you submit to Vitare regarding the Service may be used by Vitare freely and without obligation, compensation, or attribution to you. By submitting feedback you waive any claim to intellectual property rights in that feedback.
8.5 Reporting Intellectual Property Concerns
If you believe any Content within the Service infringes your intellectual property rights please contact us at support@vitaregame.com with full details of your concern. We will review all valid intellectual property notices and take appropriate action.
Section 9 — Limitation of Liability
9.1 Service Provided As-Is
The Service is provided on an "as is" and "as available" basis. Vitare makes no warranties, express or implied, regarding the Service including but not limited to its fitness for a particular purpose, uninterrupted availability, or freedom from errors, bugs, or harmful components. This is particularly relevant during the Beta phase where the Service is still in active development.
9.2 Limitation of Liability
To the fullest extent permitted by applicable law, Vitare shall not be liable for:
- Loss of V$, Virtual Items, lot ownership, or game progress whether arising from technical failure, account termination, data wipe, or any other cause
- Loss of data or corruption of Account information
- Interruption or unavailability of the Service for any reason
- Actions, conduct, or content of other players within the Service
- Any interactions between players that take place outside of the Service
- Loss of profits, revenue, or anticipated savings
- Any indirect, consequential, incidental, or special loss or damage of any kind
9.3 Cap on Liability
Where Vitare is found liable to you for any reason, our total liability to you shall not exceed the total amount paid by you to Vitare in the 12 months preceding the event giving rise to the claim. Where no payments have been made, our liability is limited to the fullest extent permitted by applicable law.
9.4 Consumer Rights
Nothing in these Terms excludes or limits Vitare's liability where it would be unlawful to do so. In particular nothing in these Terms affects your statutory rights as a consumer under applicable UK law including:
- The Consumer Rights Act 2015 — which provides that digital content and services must be of satisfactory quality, fit for purpose, and as described
- The Consumer Contracts Regulations 2013 — which provides cancellation and refund rights in respect of online purchases
Where the Service fails to meet the standards required by applicable consumer protection law you may be entitled to a remedy including repair, replacement, or refund. Please contact support@vitaregame.com in the first instance.
9.5 Force Majeure
Vitare shall not be liable for any failure or delay in the operation of the Service arising from circumstances beyond our reasonable control including but not limited to:
- Internet or network failures
- Third party service provider outages including hosting, payment processing, or content delivery services
- Distributed denial of service attacks or other malicious interference
- Natural disasters, pandemic, or acts of government
- Power failures or infrastructure outages
In such circumstances Vitare will endeavour to restore the Service as quickly as reasonably possible.
9.6 Indemnification
You agree to indemnify, defend, and hold harmless Daniel Willis trading as Vitare from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your Content within the Service
- Any interaction you have with another player whether within or outside of the Service
- Any claim by a third party arising from your conduct within the Service
Section 10 — Service Closure
10.1 Right to Discontinue
Vitare reserves the right to permanently discontinue and shut down the Service at any time. We will endeavour to provide as much notice as possible before doing so.
10.2 Notice Period
In the event of a planned permanent closure of the Service, Vitare will provide no less than 30 days notice via vitaregame.com. Where reasonably possible we will also notify players directly via the email address associated with their Account.
10.3 Refunds on Closure
Where the Service is permanently closed the following applies:
- Subscribers — players with an active subscription at the date of the closure announcement will receive a pro-rata refund of subscription fees based on the number of unused days remaining in their current billing period at the date of the announcement
- Purchased V$ — where players hold a V$ balance that was purchased with real money within the 30 day notice period, Vitare will endeavour to provide a reasonable remedy at its discretion which may include a pro-rata refund
- Earned V$ — V$ earned through gameplay rather than purchased with real money is non-refundable under any circumstances
- Virtual Items — Virtual Items have no real-world monetary value and are not subject to refund on closure
10.4 Data on Closure
Following permanent closure of the Service all player data will be deleted in accordance with our Privacy Policy. Players wishing to request a copy of their personal data before deletion should contact support@vitaregame.com as soon as possible following the closure announcement.
10.5 No Further Liability
Beyond the refund provisions set out in Section 10.3, Vitare accepts no further liability to players arising from permanent closure of the Service including loss of V$, Virtual Items, lot ownership, game progress, or any other in-game assets.
Section 11 — Dispute Resolution
11.1 Contact Us First
If you have a complaint or dispute arising from your use of the Service or these Terms, we ask that you contact us in the first instance at support@vitaregame.com before taking any further action. We will endeavour to resolve disputes informally and in good faith within a reasonable timeframe.
Please include in your communication:
- Your Account email address
- A clear description of your complaint or dispute
- Any relevant evidence or supporting information
11.2 Escalation
Where a dispute cannot be resolved informally through direct communication with Vitare, you may seek resolution through the courts of England and Wales in accordance with Section 12 — Governing Law.
11.3 Online Dispute Resolution
If you are based in the European Union you may also have access to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings but will consider doing so on a case by case basis.
11.4 No Class Actions
To the fullest extent permitted by applicable law, all disputes must be brought on an individual basis. You agree not to bring or participate in any class action, collective proceeding, or representative action against Vitare.
Section 12 — Governing Law
12.1 English Law
These Terms and any dispute or claim arising out of or in connection with them, their subject matter, or their formation shall be governed by and construed in accordance with the laws of England and Wales.

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of the Service, subject to the provisions of Section 12.3 below.
12.3 Consumer Rights — EU & Other Jurisdictions
If you are resident in a European Union member state or another jurisdiction that provides mandatory consumer protection rights, nothing in these Terms affects your right to rely on those mandatory protections. In such cases you may also have the right to bring proceedings in the courts of your country of residence.
12.4 Compliance with Local Law
You are responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction. Vitare makes no representation that the Service is appropriate or available for use in all locations. Access to the Service from jurisdictions where its content or use is prohibited is at your own risk.

13.1 Changes to These Terms
Vitare reserves the right to update or amend these Terms at any time. Where changes are material we will provide reasonable notice via vitaregame.com and where possible by direct notification to the email address associated with your Account. The date of the most recent update will always be displayed at the top of this document.
Continued use of the Service following notice of updated Terms constitutes your acceptance of those changes. If you do not agree with any changes to these Terms you must stop using the Service and may delete your Account via the My Account area of vitaregame.com.
13.2 Entire Agreement
These Terms constitute the entire agreement between you and Vitare in relation to your use of the Service and supersede all prior communications, representations, agreements, or understandings between us, whether written or oral, relating to the Service.
13.3 Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
13.4 Waiver
Any failure by Vitare to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision or any other provision in the future.
13.5 Assignment
You may not assign, transfer, or subcontract any of your rights or obligations under these Terms without prior written consent from Vitare. Vitare may assign or transfer its rights and obligations under these Terms at any time, including in the event of a business sale, merger, or restructuring. You will be notified of any such assignment that materially affects your rights.
13.6 Updates to the Service
Vitare is a live online game in active development. We reserve the right to update, modify, add to, or remove features and content from the Service at any time. Where significant changes affect core functionality we will endeavour to communicate these via vitaregame.com.
